ROCK VALLEY—A 63-year-old rural Rock Valley man was arrested Thursday, Nov. 25, on charges of second-offense operating while under the influence and possession of drug paraphernalia.

The arrest of Michael John Smit stemmed from the stop of a 2003 Chevrolet Silverado about 5:55 p.m. July 7 on Highway 18 in Rock Valley, according to the Rock Valley Police Department.

He had bloodshot, watery eyes; impaired balance and the odor of an alcoholic beverage and had an open container of alcohol in the vehicle that he dumped out, according to the incident report.

A sample of his urine was sent to the Iowa Division of Criminal Investigation Criminalistics Laboratory in Ankeny, which confirmed Smit’s blood alcohol level was above the legal limit.

During his arrest, Smit went to get his cellphone from inside his house and a deputy observed a small glass pipe next to the cellphone. There was burned marijuana residue inside the pipe.
